Terms and Conditions for Safe Raise

Welcome to Safe Raise. By accessing or using our services, you agree to be bound by the following terms and conditions (the “Agreement”). Please read them carefully before using the services.

1. Definitions

  • “Company” refers to Safe Raise, located in Lisbon Portugal.

  • “User” refers to any individual who uses the Safe Raise website or services.

  • “Services” refers to the online questionnaires, data collection, and any other tools or services provided by Safe Raise.

2. Acceptance of Terms

By using Safe Raise’s services, the User agrees to comply with and be bound by these terms and conditions. If the User does not agree, they should not access or use the services.

3. Data Collection and Use

3.1 Purpose of Data Collection
Safe Raise collects personal and sensitive information for the purpose of understanding the experiences of women during fundraising. All data will be confidential to Safe Raise to ensure that no individual can be identified.

3.2 Anonymity and Confidentiality
Safe Raise is committed to maintaining the anonymity and confidentiality of all Users. Personal identifiers will be removed from data collected, and responses will be stored in an anonymised format.

3.3 Data Usage
The data collected will be used solely for research and analysis purposes, to raise awareness, and to develop reports on the topic of sexual harassment and assault during fundraising. Safe Raise reserves the right to publish aggregated, anonymised data, but no individual story will ever be identifiable.

4. Data Protection Compliance (EU, UK, and Global)

Safe Raise is committed to ensuring that all data collected is processed in compliance with relevant global data protection laws, including the EU General Data Protection Regulation (GDPR), the UK General Data Protection Regulation (UK GDPR), and other applicable international laws.

4.1 GDPR and UK GDPR Compliance
Safe Raise ensures that the personal data of users based in the EU and the UK is handled in compliance with GDPR and UK GDPR respectively. This includes all rights and protections afforded to data subjects under these regulations.

4.2 International Data Transfers
When Safe Raise collects data from Users outside of the EU or UK, we ensure that international transfers of personal data comply with local legal frameworks, including standard contractual clauses (SCCs) and data adequacy decisions where applicable. Safe Raise collects data globally and is committed to ensuring compliance with international data transfer regulations. In cases where data is transferred outside the EU or UK, we will take all appropriate steps to ensure that data protection laws are followed, such as using data protection agreements that meet the standards of GDPR and UK GDPR.

For Users located in regions like California, Brazil, and other jurisdictions, Safe Raise ensures compliance with local data protection laws such as the CCPA (California Consumer Privacy Act), LGPD (Brazil), and any other applicable frameworks.

6. Disclaimer of Liability

6.1 No Legal Liability for Data Submission
Safe Raise provides its services "as is," without any warranties, whether express or implied. Safe Raise shall not be held liable for any claims, damages, or losses arising out of or related to the submission of data by Users, including but not limited to legal claims related to the data submitted.

6.2 No Legal Advice
Safe Raise does not provide legal advice and is not responsible for any legal outcomes or decisions made based on information or reports generated from our services. Users are encouraged to seek professional legal advice if they require it.

7. Limitation of Liability

To the fullest extent permissible by law, Safe Raise, its directors, officers, employees, or agents shall not be held liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, arising out of the use of our services.

8. User Responsibilities

The User agrees to provide accurate, complete, and truthful information. Safe Raise reserves the right to remove content or terminate a User’s access if false or harmful information is submitted.

9. Changes to Terms and Conditions

Safe Raise reserves the right to modify these terms and conditions at any time. Significant changes will be communicated to Users, and continued use of our services following the posting of changes constitutes acceptance of those changes.

10. Governing Law and Jurisdiction

For Users located in the EU, this Agreement is governed by and construed in accordance with the laws of the European Union. For Users located in the UK, this Agreement is governed by and construed in accordance with the laws of the United Kingdom. For Users located in other jurisdictions, local laws may apply, but the laws of Portugal shall generally govern any disputes arising from the use of Safe Raise's services. Disputes will be subject to the exclusive jurisdiction of the courts of the relevant country.
